Appeal Court holds back judgment on Ikpeazu’s sack

The Appeal Court on Tuesday, presided over by Hon. Justice Morenikeji Ogunwumiju, has reserved judgment on the appeal by Okezie Ikpeazu against the judgement of a Federal High Court, Abuja, which dismissed him as governor of Abia state.
Ikpeazu had filed an appeal after the judgment of Justice Okon Abang sacked him as governor and ordered Independent National Electoral Commission (INEC), to with immediate effect hand Certificate of Return to Uche Ogah, who came second in the Peoples Democratic Party (PDP) primaries that saw Ikpeazu emerge candidate of the party.
The court had last week dismissed the application of Alex Otti seeking to be joined in the matter as an interested party.
Speaking at the court, Alex Iziyon, counsel to Ogah, said it was as an abuse of court processes for the appellant to seek relief from the Abia High Court and the Appeal Court at the same time.
Counsel to Ikpeazu, Wole Olanipekun, said the motion challenging the jurisdiction of the court to hear the appeal was done in bad fate because the Abia High court had ruled that all parties must respect the outcome of court proceedings.
Ikpeazu was dismissed on accusation that he submitted forged tax documents.

Buhari "Nigeria needs change agents", - President says

President Muhammadu Buhari has said that Nigeria needs change agents as the country is currently in a critical situation.


This was contained in a tribute signed by his special adviser on media and publicity, Femi Adesina, to the pioneer Director-General of the National Institute for Policy and Strategic Studies, Kuru, Major GeneralTimothy Ogundeko.

The statement reads: “The President affirms that with his tireless efforts and foresight, Gen. Ogundeko transformed the Nigerian Army Education Corps for the benefit of the Service and the nation; and his legendary role in the establishment of Command Secondary Schools is well appreciated.
“President Buhari trusts that the vision of the deceased for a united and prosperous Nigeria will be honoured by all who mourn him, particularly at this critical point when the nation is in need of selfless citizens to change Nigeria for the better.
“The President extends heartfelt condolences to Gen. Ogundeko’s family, as well as the government and people of Ogun State.

“We must hit them before they hit us”, Chief of Army Staff on Boko Haram

The Chief of Army Staff, Tukur Buratai, says there are still remnants of Boko Haram terrorists in parts of the North East due to the vast nature of the region.
The chief of army staff stated this in a lecture to participants of Executive Course 38 at the National Institute for Policy and Strategic Studies (NIPSS), in Kuru, Plateau on Tuesday.
“They still exist in the region, especially Borno, as the area is diverse and some cannot be easily accessed.
“The land is so vast, the North East is very, very vast; you never appreciate it until you fly over that area or even drive around.
“Those remote areas are so diverse and thick with very difficult terrain.
“Now that it is the rainy season, it is very difficult to move heavy equipment, heavy tracking vehicles into some of those areas. The best time is the dry season,’’ he said.
Mr. Buratai said President Muhammadu Buhari’s decision to relocate the military control and command centre from Abuja to Maiduguri was highly profound and strategic in the counter insurgency operation.
“The movement of the military command and control centre to Maiduguri is one of the major responses of President Muhammadu Buhari toward the national security threat,’’ he said.
He also said the decision to relocate along with other service chiefs to the region to take charge and direct the operation was partly responsible for the current victory over the terrorists.
“We, service chiefs have not been in isolation. One has not been idle or kept himself out of the reality of the country as military officer, as a general, I kept track of what is going on.
“When I was appointed the chief of army, I said, this insurgency must stop, we must be responsive at all times, we should not wait and be reactive.
“I said our troops will never run away from these criminals – insurgents. We must hit them before they even come to us, not even to wait for them to attack and we repel, no.
“Immediately after my appointment, I moved to the North East.
“We – service chiefs must be part of the troops. If you want to respond properly, you must be with the troops, you must be aware of their day to day challenges.
“If you stay far away, there is no way you will understand.
“That is why I say I must be in the forefront, I must always be with the troops and that has really paid off seriously in re-aligning the morale of the troops.
“(That is why we are having) the direction, purpose, and indeed the eventual victory that we are having from day one to this moment’’, he said.
The army chief noted that collective effort was required in defeating the terrorists and acknowledged the roles being played by other arms of the security agencies, as well as the Civilian Joint Task Force.
He said insurgents that were fleeing to other parts of the country were being arrested daily with the help of members of the civilian joint task force.

Judge orders Tyga's arrest


According to TMZ, a judge has ordered the arrest of rapper Tyga after failing to show up in court today in his case with his former landlord. TMZ reports below...

The landlord got a $480,000 judgment against the rapper who fell way behind on rent and left the Malibu home in shambles. Tyga hasn't paid the judgment, so the landlord wants to know where Tyga's hiding his assets. Attorneys for the landlord were in court today, explaining the landlord was upset over stories he saw that Tyga bought Kylie a $200,000 car for her birthday, which he claims is a fraudulent transfer of assets that should go to satisfy the judgment.
The judge issued a bench warrant, which means Tyga could go to jail. The rapper's finances have been curious for a long time. He's had cars repoed, he's been evicted, but he still lives like a king. He recently rented a mansion for $46k a month. #Priorities

Sierra Leone and Liberia risk new deadly epidemics akin to the impact of the Ebola virus due to lack of clean water and hygienic conditions in most homes, an NGO warned Tuesday.
WaterAid said the two provisions were the “first line of defence” against infectious diseases but needed to be put into place before outbreaks began.
In Sierra Leone, more than 37 percent of people do not have access to clean water, the British-based group said in a statement. In Liberia, the figure is 24.5 percent.
When it comes to basic sanitation, WaterAid said the figures were even higher — 86.7 percent of people in Sierra Leone and just over 83 percent in Liberia live without access to it.
“The terrible suffering of the people of Sierra Leone and Liberia during the Ebola crisis is at high risk of being repeated in another disease epidemic if we do not see action to improve water, sanitation and hygiene practices in our communities, schools and healthcare facilities,” WaterAid’s Joe Lambongang said in the statement. 
“These basic provisions are the first line of defence against infectious diseases including Ebola.
“To ask healthcare professionals to battle an epidemic without clean water, safe toilets and somewhere to wash their hands is unrealistic and needlessly puts lives at risk,” he added.
In June, Liberia said it was free of Ebola, meaning there were no known cases in west Africa of the tropical virus that left more than 11,300 people dead in the region since late 2013.
The World Health Organization declared an end on June 1 to Ebola cases in Guinea — where it first broke out in December 2013 — and in Sierra Leone on March 17.
According Sierra Leone’s health ministry figures, 30 percent of the population dies every year of diseases passed on by contaminated water.

The Police on Tuesday uncovered a cache of ammunition buried at a construction site at Umuowelle, Agulu in Anaocha council area of Anambra State.
The Police Public Relations Officer in the state, ASP Nkeiru Nwode, said the ammunition were unearthed by some labourers who were digging the foundation of the building .
Nwode said the workers reported to Neni Police Division which went to the place and cordoned it off.
She said the discovery which was in different sizes and calibers was worth millions of the naira.
She said the Commissioner of Police in the state, Mr Sam Kaula led a team of officers to site to supervise the evacuation of the ammunition.
She said “The Police this morning discovered a large quantity of ammunition at a parcel of land where building work was going on at Umuowelle, Agulu in Anaocha.

EFCC charges 3 coys linked to Jonathan’s ex-aide over alleged N4.9bn fraud

The Economic and Financial Crimes Commission (EFCC) has charged three companies linked to former Senior Special Assistant to ex-President Goodluck Jonathan on Domestic Affairs, Waripamo-Owei Dudafa.
They are Pluto Property and Investment Company Limited, Seagate Property Development and Investment Company Limited and Trans Ocean Property and Investment Company Limited.
They were charged before Justice Abdulazeez Anka of the Federal High Court in Lagos, along with Sombre Omeibi, who is said to be at large.
Dudafa was arraigned on June 15 before Justice Mohammed Idris for allegedly conspiring to conceal proceeds of crime amounting to over N1.6billion on June 11, 2013.
He was arraigned along with Iwejuo Joseph Nna (alias Taiwo A. Ebenezer and Olugbenga Isaiah) on a 23-count charge of conspiracy and concealment of crime proceeds.
The defendants allegedly concealed the money through Seagate Property Development and Investment, an offence contrary to Section 18(a) of the Money Laundering (Prohibition) (Amendment) Act, 2012 and punishable under Section 17(a).
They were also accused of knowingly concealing proceeds of crime through Avalon Global Property Development Company Limited in the sum of N 399, 470,000.00, among others.
In the new charge, the three companies were accused of indirectly retaining $15,591,700 (about N4, 981,548,150), which they reasonably ought to have known formed part of the proceed of an unlawful act.
The alleged offence is contrary to Section 18(a) of the Money Laundering (Prohibition) Amendment Act, 2012, and punishable under Section 15(3) of the same Act.

3 men bag 10 months imprisonment, 10 lashes each for theft

Abuja, Aug. 9, 2016 (NAN) A Gudu Upper Area Court on Tuesday sentenced three men to 10 months in prison each for stealing a Mercedes Benz truck.
The presiding officer, Mr Umar Kagarko, also ordered that the convicts be flogged 10 strokes of the cane each.
Kagark, in his judgment, admonished them to desist from a life of crime, and gave the convicts an option of N100,000 fines each.
He decried the crime and said that the punishment was light because of the plea of the defence counsel.
The convicts, Patrick Okoro, a 38-year-old artisan; Jude Okafor, 31-year-old mechanic and Anthony Okoye, 30-year-old driver, all pleaded guilty to the charges.
They were arraigned on a three-count charge of criminal conspiracy, mischief and theft.
The prosecutor, Mr Augustine Urom, had told the court that Desmond Obelu of Katampe reported the matter at the Kubwa Police Division on June 14.
He told the court that the complainant reported that his Mercedes Benz truck, APP 13 XE, valued N1.8 million was stolen from where he parked it in Katampe, Kubwa.
“He had to send messages to his fellow drivers and one of them called and informed him that he saw the truck moving toward Enugu state,’’ Urom said.
He said this prompted the police to act, which led to the arrest of the convicts at Obolo Ofor in Enugu state, but their leader, Ifeanyi Chukwu escaped.
The prosecutor also said that during police investigation, the convicts confessed that they gained access into the truck after removing the windscreen.
“They, thereafter, used force to turn the steering of the truck, removed the ignition and started it manually.’’
Urom said the offence contravened sections 97, 327 and 287 of the Penal Code. (NAN)

Commuters groan as BRT drivers protest salary delay

Commuters in Lagos on Tuesday groaned as drivers of the Lagos State’s Bus Rapid Transport (BRT) downed tools over alleged delay of their salary.
The News Agency of Nigeria (NAN) reports that the scheme, being operated by Primero Transport Services Ltd., provides bus services along dedicated lanes or corridor in the Lagos metropolis.
The company, which began operation in November 2015, has 434 buses in its fleet and more than 2,000 staff.
Some of the drivers told NAN that they were protesting delayed salary payment, alleged unfavourable conditions of service and poor welfare.
When NAN visited the Majidun, Ikorodu depot of the transport company, hundreds of drivers had converged on the bus corridor and barricaded it to prevent movement.
Also, buses belonging to the company were seen parked outside.
A driver, Mr Julius Adejire, told NAN: “For the past days we have been waiting for our salary for July but up to this moment we have not received alert for the payment.
“The funny thing is that as at Monday evening, we discovered that some other staffers, including the engineers and ground staff have been receiving alert.
“But the drivers have not received ours; can we drive this bus with an empty stomach?’’
Adejire said that apart from delayed salary, the drivers wanted improved welfare and working conditions.
“The policy guiding our job is another issue; we are working like slaves because as a driver you cannot stop to ease yourself or have break time or hour.
“We are supposed to be doing 40 hours in a week but they subdued us to be doing 48 hours and only one day off instead of two days.
“We have been tolerating them before now because we believe this a new project and we thought it needs to be supported, but now the situation is becoming tougher.
“We don’t even know where we are heading; the buses are still new, is it when the buses go bad that they will pay us?’’
He added that the management had reneged on is contractual agreement to pay N60, 000 as basic salary and N20,000 as bonus.
“In our appointment letter they said we will receive N60,000 as basic salary and N20,000 as performance bonus.
“Suddenly, after five months they changed it to N40,000 basic and N40,000 bonus with a lot of conditions attached to the bonus.
“For instance, a driver will be denied the bonus pay if he or she is late to work for at least three times a month.
“With the conditions attached to it, if care is not taken, 85 per cent of us cannot get that performance bonus.
“You are trying to instil discipline, but there is no staff bus for drivers who come from as far as Sango Ota, Badagry and Agbara without accommodation arrangement,’’ he said.
He added that drivers who could not afford to sleep on the bridge adjourning the BRT bus shelter often paid N500 monthly to sleep in a nearby church.
“We have pleaded with them to give us a place, but that is not forthcoming.
“So, what we are saying now is that they should pay us our salary as well as revert to the first appointment letter we were given.
“They should also tell us the exact day of the month we will be receiving our salary.
“This is the only job we depend on but the salary is often delayed, so how do we survive; we don’t collect pension even if you work for 10 years,’’ he said.
Another driver, Mathew Oyeyemi, told NAN that the alleged delayed salary had made it difficult for him to offset the medical bills of his daughter who was recently involved in an accident.
“As for me, I have a daughter who had an accident and whose bills I have to pay because I don’t have medical insurance yet.
“Moreover, I have other kids, and my wife is there also; I have been trying hard to convince her that I have not been paid but she won’t take any of that.
“I don’t understand why we are being treated like this; they make money every day; even if they want to reducet our salary to N40,000 they should pay in time,’’ he said.
NAN reports that attempts by the company’s Managing Director, Mr Fola Tinubu to have the protesting drivers resume work proved abortive as the drivers denied being calmed.
Mr Fola Tinubu, hinged the delay in salary payment on an error on the part of the banking institution handing the disbursement of the salary.
He said: “What is happening according to what they say is that we did not pay them on time, but it is really due to an error and we’ve corrected it.
“The money was paid yesterday; so why they are doing this now beats me because the money should be in their account by now and I have been trying to tell them’’.
On the allegation of reviewed salary structure, Tinubu said the company’s management took the decision to review the salary to instil discipline in the protesting drivers.
“When I took over, they were being paid a basic salary of N60,000 and bonus of N20,000, but nobody was being paid the bonus.
“So, the moment I took over, I thought it was unfair for them not to pay their bonus and I made sure they get their bonus.
“But what we discovered that majority of them are not conscientious and when they take the buses out they just park somewhere and don’t work.
“So, we decided to shift the salary to N40,000 and the bonus to N40,000; it is exactly the same amount.
“We are not trying to take money away from them but we don’t want to pay people that will not work.
“The only people that it will affect are people that refuse to work and we don’t want those people in the system anyway.
“What we’ve done is to incentivise them to work and we are not asking them to work any harder.
“The way the country is today you cannot expect us to be paying people that don’t want to work, so that’s the genesis of the whole, issue,’’ he said.
The managing director added that the management would not rest on its oars to ensure that workers got their entitlement and reward hard work.
“We’ve even laid a very generous path for them that show that if you get your bonuses consecutively for six months you get an automatic pay increase.
“I am even talking to some people to see how they can build a hostel for them near our office here that they will pay for.
“So, there are so many things we are doing to make their life comfortable, but this (protest) is not going to help because of loss of revenue.
Meanwhile, some stranded passengers who spoke to NAN expressed their disappointment and urged the Lagos State Government to intervene in the matter in the interest of commuters and residents of Lagos.
Mr Hakeen Abdulraham, an insurance broker, said: “The buses have been a sort of life saver, especially for residents of Ikorodu because the comfort and relative cheaper fares.
“But I was shocked when I got to the bus terminal early today to discover that the buses had yet to arrive even as at 6.30 am.
“It is quite disappointing that this is happening at a time when the economy is biting hard as some of the yellow-painted commercial may want to take undue advantage of the situation to charge high fares,’’ he said. (NAN)
